    Hi there,

    I am a British national who has recently resigned from his job here. I am now looking at my tax situation and want to understand whether or not I have to pay tax here or not, and if I do, whether I am responsible for remitting it to the authorities or whether my employer is?

    I’m not convinced that my company will pay the tax and am asking for them to pay it to me so that I can file it from the UK as I can’t access my accounts in China from the UK). Does anyone know if I am within my rights to do this?

    Any help or information you could give would be much appreciated. I am paid 20,000 RMB per month and have an additional allowance of 6000 RMB

    Forgot to add….I have been working in China since March 20019, so have not been resident in China for a full tax year.

    If you have been in China for 183 days or more then you are considered to be a resident tax payer and have to remit income taxes. That’s not continuous residence by the way, just total days within one tax year.

    If you have been here less than 5 years then you only pay on your China sourced income.

    I have no idea about UK tax law.

    It sounds almost like you are going home now that you aren’t working here; if that’s the case then that may impact your decision.

    Based on 20K RMB/mo you should pay around 2700 RMB/mo. I’m guessing the 6K is a tax-free allowance for housing, transportation and food.

    The company should be paying it directly for you, but many often just pocket the money, so one never knows without proof.

    That being said, since your leaving soon – don’t worry about the last months taxes.
